NO EMERGENCY MEDICAL SERVICES ARE OFFERED THROUGH THE DRFT APPLICATION.
Welcome to DRFT AI Inc. ("DRFT," "we," "us," or "our"). These Terms of Service govern your use of the DRFT Application and all related Services made available by DRFT AI, Inc, a Delaware corporation ("Company," "we," "us," or "our").
This EULA contains important information that governs your use of the Application and the Services. Please read this EULA carefully. By clicking "I Accept," downloading, installing, or using the Application or Services on any related websites you will indicate your acceptance of this EULA. You may also accept this EULA (1) through any printed, oral, or electronic statement, including an electronic click-through agreement, that you have reviewed and accepted this EULA; (2) by using the Application or the Services; or (3) by creating an account on the Application (if applicable to you).
If you do not agree with this EULA, please do not proceed with, or promptly discontinue your use of, the Application and the Services.
IMPORTANT:
THIS EULA CONTAINS A MANDATORY ARBITRATION PROVISION IN SECTION 12 THAT REQUIRES THE USE OF ARBITRATION ON AN INDIVIDUAL BASIS TO RESOLVE DISPUTES, RATHER THAN JURY TRIALS. THIS MEANS THAT YOU AND DRFT WAIVE ARE EACH GIVING UP RIGHTS TO SUE EACH OTHER IN COURT, INCLUDING CLASS ACTIONS OR JURY.
1. General Provisions
Definitions
The following definitions apply to this EULA:
"Application" means collectively (1) the smartphone and/or tablet-based "DRFT" mobile app made available by DRFT for provision of Services; and (2) any other platforms or associated mobile or web-based application that is made available by DRFT for provision of Services.
"Content" means descriptions, text, graphics, images, music, sound, video, and feedback, images, text, illustrations, reports, data, text, music, sounds, photographs, graphics, video, messages, tags, content, programming, software, written and other materials that are made available to you through or in connection with the Services, including on the Application, as well as any materials that you may submit or upload to the Services.
"Feedback" means any ideas, concepts, feedback, reviews, suggestions, questions, and know-how that a User makes available in connection with the Application or Services.
"Services" means all services rendered by DRFT through the Application, including our use of conversational techniques powered by an artificial intelligence powered technology to guide you through self-help methods, or other techniques, to support your mental health and behavioral intelligence. The Services may include conversations with you about your situation, features and functionality.
2. User Consents
Electronic Communication
You understand and acknowledge that in order to facilitate the provision and functioning of the Application and the Services, we may need to get in touch with you from time to time. We may contact you using the email address and/or phone number that you provide to us when you create your data, or that changes from your service providers in connection with communications through the Application. You acknowledge and understand that standard messaging and data rates may apply, and you hereby provide your permission to access certain functions and information on your mobile device.
3. Privacy
You understand that in order to provide the Services and the Application, and to determine your identity as required under applicable law, we may need to collect, store, and use certain information related to you. Your information includes information that is entered by you using the Application, or information that is entered by you using the Application or the Services (collectively, "Your Information"). Your Information includes information that is entered by you while using the Application, information that is automatically collected by third-party applications installed on the smartphone or tablet device owned by you. If you are sharing our Application with others, your information may also be shared with them. EULA shared with certain other third parties in connection with the provision of the Application and the Services and may become part of a record established by DRFT. Please review our Privacy Policy, which is incorporated herein, as it may be used for the purpose of training or providing an artificial intelligence or machine learning model, as described above, in connection with the Services.
4. Behavioral Intelligence Services
DRFT provides AI-powered behavioral intelligence services designed to help users understand and improve their behavioral patterns. Our services analyze digital footprints and behavioral data to provide insights and predictions about potential behavioral drift or crisis situations.
5. Limitations and Disclaimers
THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. DRFT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
